Pre-pleading & Pre-sentencing Memorandums

In most cases, following a thorough investigation and clinical assessment, we prepare a comprehensive forensic report for the Court. This report provides a detailed account of the client's developmental, psychological, educational, and social history, identifies specific mitigating factors relevant to culpability, and includes a clinically grounded recommendation tailored to the individual’s circumstances.
When appropriate, the report is supported by corroborating documentation, which may include:

Medical and psychiatric records
Treatment histories
Employment and financial records
Other relevant personal and family background information

Additionally, we include letters of support from family members, mentors, and respected community figures to provide a broader perspective on the client’s character, support network, and potential for rehabilitation.
Comprehensive Psychosocial Assessments & Investigations
​​
Our licensed clinical social workers conduct comprehensive psychosocial investigations to identify and evaluate the mitigating factors that may have contributed to an individual's involvement in the criminal justice system. These investigations are designed to contextualize behavior within the broader framework of the client’s life experiences, environment, and clinical needs.

The investigative process includes, but is not limited to:

Conducting in-depth clinical interviews and assessments with the client

Interviewing family members, peers, and other collateral sources

Obtaining and analyzing relevant records (e.g., educational, medical, mental health, legal, and employment)

Exploring cultural background, religion & spirituality, developmental history, family dynamics, community and environmental influences, medical and psychiatric conditions, substance use, and other psychosocial stressors

Communicating with current and former treatment providers for continuity and corroboration of care
As part of this process, we also conduct a structured needs assessment to identify the services, interventions, and support systems that can promote behavioral change, reduce recidivism, and enhance the client’s ability to lead a healthier and more prosocial life.
Youthful Offender Adjudication

A youthful offender is defined as a person who is between the ages of 16 and 19 years of age (16,17,18 and not yet 19) at the time they commit a crime. It is designed to give the young offender an opportunity to have a criminal conviction converted to a non-criminal determination of youthful offender.
Securing a Youthful Offender adjudication is critical, as a felony conviction can carry lasting, life-altering consequences for young people. These may include the loss of access to financial aid, student loans, housing opportunities, employment, voting rights, and eligibility for professional licenses. Ensuring that youth have the opportunity for rehabilitation rather than lifelong punishment is essential to fostering their growth and reintegration into society.
Our team provides comprehensive clinical evaluations to identify the underlying psychological, social, and developmental factors contributing to a young person’s behavior. To support a successful outcome, we offer a range of evidence-informed interventions tailored to the individual's needs.

We also conduct home and community assessments to better understand the environment and identify supportive services that can promote long-term stability and positive change.

Verbal Advocacy in Court

We are available to consult directly with judges and court-appointed personnel regarding an individual’s case.
​
Following a comprehensive assessment, we are frequently invited by legal counsel to appear in court and present our clinical impressions to the Presiding Judge. In these instances, we offer evidence-based insights and articulate recommendations grounded in psychological and social evaluations.
Our presence in court reinforces the integrity of our work and signals to the Court our active investment in supporting the client’s rehabilitation.
By addressing the underlying psychosocial factors that may have contributed to the individual’s legal involvement, we help promote outcomes that prioritize both personal accountability and public safety.
Program Placement & Monitoring
Whether court-mandated or voluntary, many individuals require placement in structured treatment programs to address underlying behavioral health issues contributing to their legal involvement.

We assist clients in identifying and enrolling in programs that both satisfy court requirements and align with the individual's clinical needs, ensuring access to the most appropriate and effective care available.
In addition, we provide ongoing monitoring and support throughout the treatment process. Our goal is to help the individual navigate barriers to success, promote engagement in services, and reinforce accountability.Progress and compliance are documented and communicated to the Court through formal treatment reports, direct advocacy, or both.
When appropriate, we advocate for the individual to ensure the Court receives a comprehensive and balanced understanding of their progress and potential for rehabilitation.

Psychotherapy

FMC collaborates with Licensed Clinical Social Workers (LCSWs) who are legally authorized in New York State to independently diagnose mental health conditions, provide psychotherapy, and develop assessment-based treatment plans for both court-mandated and voluntary clients.
